If you're using Aichemy on behalf of someone else or another entity, please ensure you possess the necessary authorization to bind them to these Terms, guaranteeing their compliance and accountability for any deviations.

Description of Aichemy
Aichemy is a software that employs artificial intelligence algorithms to refine images. These algorithms modify the foreground and background, integrate diverse elements, and derive inspiration from various visual sources, including the works of notable artists. Each photo is crafted by the artificial intelligence, influenced by a myriad of styles. The outcome is contingent upon the specific style selected by the user, and the quality of the training images uploaded by the user.
Aichemy's spectrum of capabilities includes:
Fluidly generating visuals via the application
Onboarding pre-existing visuals onto the application platform
Creating an AI model trained by Stable Diffusion
Enabling the user to generate artwork based upon prompts that they create
After selecting their training photos, users can choose from a wide range of artistic filters and effects. Once a choice is made, Aichemy's algorithm gets to work on the transformation. The final artistic output can be shared on different online platforms or saved for personal viewing and enjoyment.
Limitation of Liability
Neither the Company nor its associates or affiliates (collectively, the “Company Parties”) shall be held accountable to you based on any legal reasoning - be it contract, tort, negligence, strict liability, warranty, or any other grounds - for any secondary, consequential, exemplary, unexpected, punitive, or special damages or lost profits, even if the potential of such damages has been made known to you. The cumulative responsibility of the Company and the other Company Parties, concerning any claim resulting from or associated with these Terms or Aichemy, irrespective of the nature of the claim, is restricted to the amount, if any, you've paid to utilize Aichemy. The Company's maximum liability related to these Terms, whether arising from the use or the inability to use Aichemy, shall not surpass the amounts you've disbursed to use Aichemy or ten ($10) U.S. dollars, should you have no payment commitments towards the Company. The aforementioned exclusion and limitation of damages are foundational to the agreement between the Company and you. The constraints detailed in this section won't diminish or eliminate responsibility for deliberate deceit or willful misconduct by the Company or the other Company Parties, or for any other instances where accountability can't be excluded or restricted under prevailing laws. Furthermore, certain regions do not permit the exclusion or limitation of certain damages, meaning the aforestated limitations or exclusions may not be relevant to you.
Indemnification
As allowed by relevant law, you agree to indemnify, defend, and hold us, along with our respective officers, directors, agents, partners, and employees (both individually and as a group, referred to as “Company Parties”) free from any loss, liability, claim, demand, damages, expenses, or costs (“Claims”) that arise from or relate to (i) your use of Aichemy; (ii) the content you provide or feedback; (iii) any breach of these Terms by you; (iv) any violation, misappropriation, or infringement by you of another's rights, including intellectual property or privacy rights; and (v) your actions associated with Aichemy. You commit to quickly informing the Company Parties about any Claims by third parties, collaborating with the Company Parties in addressing these Claims, and covering all fees, costs, and expenses related to defending such Claims (this includes, but isn’t limited to, legal fees). You also acknowledge that the Company Parties will oversee the defense or resolution of any third-party Claims. This indemnification complements any other written agreements between you and us or the Company Parties regarding indemnification.

We have no control over, nor do we endorse or accept responsibility for, any User Content (including its potential loss) or content from third parties linked to Aichemy. You accept and understand that the sole responsibility and risk associated with using any third-party websites or resources rests with you. Your interaction with Aichemy is entirely at your own discretion and risk. Aichemy is offered "as is" and "as available," without any explicit or implicit guarantees, including, but not restricted to, the implied warranties of saleability, suitability for a specific purpose, title, and non-violation. We also do not claim or guarantee that Aichemy is precise, thorough, reliable, up-to-date, or free from errors or potentially harmful components. The entire responsibility regarding Aichemy's quality and performance within your usage falls on you. The app features incorporate Stable Diffusion. Consequently, we can't have complete oversight over the outcomes produced by the application. Hence, these Avatars should not be seen as a reflection of our official stance or viewpoint concerning any religion, ethnic group, club, organization, company, individual, or any entity or concept. While we strive to regulate the feature by adjusting the AI settings available to us, we can't and don't control the User Content. By consenting to these Terms and/or acquiring a subscription, you acknowledge the aforementioned disclaimer and relinquish any claims against us due to the Avatars produced.
Release
To the maximum extent permitted by applicable UK law, you absolve the Company and the other Company Parties from any responsibility, liability, claims, demands, and/or damages (both actual and consequential) of every kind, both acknowledged and unacknowledged, arising from or related to disputes between Users and the actions or omissions of third parties. You knowingly renounce any protective rights under any pertinent UK regulations or common law principles that would otherwise confine the scope of this release to only those claims which you might be aware of or presume to exist in your favour at the time of accepting this release.
ToS Updates
We may occasionally update these Terms. Should there be significant modifications that might impact your rights, we will ensure you are informed, whether through in-app notifications, email, or other appropriate communication channels. If the revised terms are not to your liking, you should cease your use of Aichemy. Persisting with Aichemy post-notification signifies your consent to the revised terms.
